Family Law Act 1996

Non-Molestation Order (NMO)

A Non-Molestation Order is an injunction order that helps protect you and your children from someone who is hurting you or making you feel afraid. It can stop contact, harassment and threats of harm.

What Is It?

The court can tailor the order to your situation. Depending on its terms, the person causing harm may be prohibited from:

  • Use or threaten any kind of violence towards you
  • Harass you, intimidate you, or pester you
  • Contact you in any way, whether directly or through someone else, including calls, messages, or social media
  • Come near your home or anywhere you are currently staying

The order is intended to protect you from harmful behaviour. Most of these orders last around 6 months, though this can be extended to 12 months or more if it is still needed.

Who Is This For?

Anyone who has experienced abuse can ask for this kind of protection, as long as they have some kind of connection to the person causing harm. This usually includes someone who is, or was:

  • A current or former partner
  • A husband, wife, or former spouse
  • A family member, such as a parent, sibling, child, aunt, or uncle
  • Someone you have lived with
  • Someone who shares responsibility for a child with you
  • Someone you were in a relationship with for some time

Requests like this are handled through a proper system that deals with these kinds of cases, and they can be dealt with quickly if you are in immediate danger.

What Happens If The Order Is Breached?

If the order is broken, this is treated as a very serious matter. Should the other person break any part of it:

  • They can be confined straight away, without needing extra paperwork first
  • This can lead to further serious consequences for them
  • They may face a lengthy period away from you, along with a financial penalty
